By accessing and using Pomofy ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Pomofy is a productivity timer application offering:

• Free Tier: Basic Pomodoro timer functionality
• Premium Tier: Extended features including extended session history (30 days) and future premium features

3. Account Registration

To access premium features, you must:

• Create an account with a valid email address
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of unauthorized access

You are responsible for all activities under your account.

4. Premium Subscription

4.1 Subscription Plans

Premium subscriptions are billed monthly at $5.00/month. Pricing may change with 30 days notice.

4.2 Billing and Payment

• Subscriptions renew automatically each month
• Payment is processed via Stripe
• You will be charged at the start of each billing cycle
• Failed payments may result in service suspension

4.3 Cancellation

You may cancel your subscription at any time through Account Settings. Cancellation takes effect at the end of the current billing period. You will retain premium access until the end of your paid period.

5. Acceptable Use

You agree not to:

• Violate any laws or regulations
• Infringe intellectual property rights
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use the Service for any commercial purpose without permission
• Reverse engineer or attempt to extract source code

6. Intellectual Property

The Service and its content (including code, design, logos, and documentation) are owned by Pomofy and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.

7. Privacy and Data

Your use of the Service is governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Maintenance and updates
• Technical difficulties
• Factors beyond our control

We are not liable for any loss resulting from Service unavailability.

9. Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Abuse or misuse the Service

Upon termination, your right to use the Service ceases immediately. No refunds will be provided for terminated accounts.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your requirements
• The Service will be error-free or uninterrupted
• Any errors will be corrected
• The Service is free from viruses or harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POMOFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

Our total liability for any claims shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Pomofy from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

13. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms. Material changes will be communicated via email or Service notification.

14. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of the United States.
